Permit pursuant to the Protection of Geographic Information Act

Both the Protection of Geographic Information Act and Ordinance require that a distribution permit is obtained for publishing or distributing compilations of geographic information in any other way.

Section 9 of the Protection of Geographic Information Act (2016:319) states that the distribution of compilations of geographic information is prohibited:

  1. If the conditions in a specific water area or certain sections of a water area relate to Swedish territorial waters, except lakes, waterways and canals; or
  2. Over other areas of Swedish territory if the information is collected from an aircraft using photography or similar recording method.

“Geographic Information” refers to “position-based information regarding the conditions on and below ground and both on and below the sea bed”.

The Swedish Maritime Administration issue permits in accordance with Point 1 and Lantmäteriet issue permits in accordance with Point 2.
